Disclaimer and Acknowledgment Form

This form outlines the legal obligations of both parties and provides important disclaimers regarding services facilitated by Rainbow Disability Services.

Rainbow Disability Services – Referred to as “the Provider,” acting as a registered NDIS disability support provider.

Acknowledgment and Agreement

  1. Provider’s Role
    • Rainbow Disability Services operates as a registered NDIS provider delivering personalised disability support services to participants in Tasmania.
    • The Provider delivers supports including but not limited to: Supported Independent Living (SIL), Daily Living Assistance, Community Participation, Personal Care, and In-Home Care.
    • The Provider acts in accordance with the NDIS Practice Standards, Quality Indicators, and the NDIS Code of Conduct.
  2. Legal Obligations of the Participant
    • The Participant acknowledges that it is their responsibility to ensure all information provided to the Provider is accurate and truthful.
    • The Participant must adhere to all relevant laws, policies, and procedures as outlined in the Service Agreement and NDIS guidelines.
  3. Non-Liability Clause
    • Rainbow Disability Services is not liable for any damages or losses arising from the following:
      • Inaccurate or incomplete information provided by the Participant or their representative.
      • Changes to the Participant’s NDIS plan or funding by the NDIA.
      • Circumstances beyond the reasonable control of the Provider.
  4. Refund Policy
    • Any billing disputes must be addressed directly with Rainbow Disability Services in accordance with the Service Agreement.
    • Short Notice Cancellations (less than 7 days notice) may incur charges as per the NDIS Pricing Arrangements and Price Limits.
  5. Indemnity
    • The Participant agrees to indemnify Rainbow Disability Services from any claims, disputes, or liabilities arising from the provision of supports, to the extent permitted by law.
  6. Privacy and Confidentiality
    • Rainbow Disability Services collects and manages personal information in accordance with the Australian Privacy Act 1988 and the NDIS Quality and Safeguards Commission requirements.
    • Personal information will only be shared with the Participant’s consent or as required by law.
  7. Complaints and Feedback
    • Participants have the right to raise concerns or complaints at any time. Complaints can be directed to Rainbow Disability Services or escalated to the NDIS Quality and Safeguards Commission.

Acknowledgement of Country

By engaging with the services provided by Rainbow Disability Services, the Participant acknowledges and agrees to the terms outlined in this disclaimer. Rainbow Disability Services acts as a registered NDIS provider, delivering quality disability support services directly to participants. The Provider holds responsibility for the safe and competent delivery of supports as outlined in the Service Agreement. The Participant agrees to adhere to all applicable NDIS laws, policies, and procedures, and indemnifies Rainbow Disability Services against any claims or disputes arising from the provision of agreed supports to the extent permitted by law.
